ALR Hearings in Texas

Standing by You Every Step of The Way

If you’ve been pulled over for a DWI and failed or refused to take a blood or breath test, you may be eligible to request an Administrative License Revocation (ALR) Hearing. As skilled and experienced DWI attorneys in Lubbock, we can offer you a committed and aggressive legal defense when you retain our services.

In cases of ALR hearings, time is very sensitive—you must submit a request for an ALR hearing within 15 days of your arrest. The Process of an ALR Hearing

An ALR hearing is separate from any court proceedings you may face for your DWI charges and its main purpose is to challenge the suspension of your driver’s license. During the hearing, the Administrative Law Judge (ALJ) will listen to the evidence the Department of Public Safety has and will decide whether or not they have proven its case.

During an ALR hearing, the Department of Public Safety must prove the following:

  • There was reasonable suspicion/probable cause to stop and arrest the driver
  • The driver was placed under arrest and was given the opportunity to take a breath or blood test
  • The driver refused the opportunity to take a breath or blood test or the driver failed by registering a blood alcohol concentration .08 or greater
